Woodbury Select Board – Special Meeting
Monday, August 17, 2026, 5: 30 P.M.
at the Town Clerk’s Office
MINUTES

The meeting was called to order at 5:33. Meeting was recorded on Chris Casey’s
phone and the recording will be posted on the town web site. Present were Select
Board members Chris Casey, John Gordon and Diana Peduzzi, and Road
Commissioner Peter Dailey.

A motion to enter Executive Session pursuant to 1 V.S.A. §313(a)(3) for the
purpose of interviewing John Phelps, applying for the position of full-time road
crew member.

The Executive Session was closed at 6:04 and Phelps left the meeting. The Board
voted to offer him the position at a rate of $29/hour and also to grant the same pay
rate to Tim Neill. Peter left the meeting.

Larry Ferno joined the meeting. The pending contract for his services to demolish
two buildings in Woodbury Village, had been reviewed by Ferno and the Select
Board. Suggested changes were made by removing any reference to Asbestos
Removal. The contract was signed and witnessed. Ferno will not be able to work
in the buildings until the asbestos (and other hazardous wastes) have been
removed, but he may start on some site work outside of the buildings.

Treasurer Lilly Baron joined the meeting and presented updated reports which
incorporated the budget adjustments the Board previously approved. She also
presented a document summarizing the reasons for the increase in the tax rate.
The voter-approved budgets were $639,081 (General Fund) and $864,599
(Highway Fund) for a total of $1,503,600. After some adjustments up and down,
the tax rate was set for a budget of $1,302,127. The municipal tax rate will be
$.9719 per $100 of property assessment. Increases affecting the tax rate include
the $105,000 that had to be returned to FEMA, cost over-run on the Valley Lake
Road culvert of $25,000, and a cost overrun on a new truck that was budgeted for
$200,000 and ended up at $300,000.

Updates and Other Business

- Health Department still has not approved the appointment of our new Health
Officer Kathryn Saunders. Chris is following up.
- Board signed a form approving the pay rates that were approved as of 8/1
- The library wants to use the town’s credit card to make purchases on line.
- Discussed legal advice regarding his review of the draft agreement regarding
the East Long Pond dam repair project. Attorney wonders why the HED
would not be more appropriate fiscal agent for handling donations and grants.
- Carol Ray reported that a Town Truck had dinged the corner of the building
which houses the food pantry. Ownership of the building is not clear but it is
not owned by the Town. The Board agreed to pay for half of the repair of the
damage. Total bill was about $1600. Vote was 2 in favor, one abstained.
- Chris reported on a call from the OSSU Superintendent with bad news from
the state Fire Marshall – use of the third floor (gym) must be limited to 45
people until the fire escape is replaced and a sprinkler system is installed. This
would mean we would need to find another venue for Town Meeting. Paul
Cerutti, former State Fire Marshall and Woodbury Fire Chief, will help the
town/school to negotiate these restrictions.

At 7:20 the Board voted to enter Executive Session (1 V.S.A. §313(a)(1)(E)) to
discuss correspondence regarding the Swenson case. The session was closed at 7:40.
No vote was taken. Chris will contact Attorney Mears.

Special Meeting –
Select Board Members Diana Peduzzi, John Gordon, Chris Casey
and Treasurer Lilly Baron met at 5:00 to go over budget adjustments and to hear from Peter Dailey about a
potential applicant for the open full- time Road Crew Member. Another special meeting was scheduled for August
17 to interview the candidate and to finalize the municipal tax rate. This was an open meeting and was recorded.

Chris called the regular meeting to order at 6:10 p.m.

Adjustments to the Agenda Authorization to sign GA1412 /MRGP grant award notice placed in
Grant Updates. Chris asked about t he status of the reclassification of TH 21. He was informed that the written
request for reclassification had yet to be submitted. Chris also asked about an email he had received regarding the
Road Erosion Inventory. Michael mentioned he had responde d to the sender of the email and that all was okay
with the sender and the town’s status with its update of the REI.
Approval of Previous Meeting Minutes
The minutes from July 21, 2026 Select Board meetings were approved as amended in the meeting. Minutes f rom
the July 27
th
WSB special meeting were approved.
Public Comment Robin Durkee presented a petition signed by more than 5% of registered voters, which
asked the board to convene a special town meeting for the purpose of voting on whether Town Officials should be
elected by Australian Ballot in the future. Robin was advised to deliver the petition to the Town Clerk, after which
date the Select Board has 60 days to warn the meeting.
Robin then asked about status of the Town Health Officer (HO) appointment. She stated Chris is still listed as the
town’s HO on VDH ’s website (and on the Town website.) Kathryn Saunders, HO for Worcester and Calais, was
appointed by the WSB to be Woodbury’s HO but the appointment must be confirmed by the VT Dept. of Health.
Chris was told by VDH that the change would occur after August 1
st
. Chris will follow up with VDH .
Road Report with Peter Dailey
The road crew has started work on Valley Lake Road as it enters Woodbury village. This work is funded by a Better
Roads grant. Dian a asked about the knotweed in the ditches that will be dug up for disposal elsewhere. Peter
explained that the material from the ditching is going to Andrew Laggis’s property, over a bank where the
knotweed will be well buried. Peter also shared that he has not done anything about the 550 and is waiting for
direction from the WSB. Chris is brought up to speed on previous discussions and more discussion followed
between the WSB, Peter and Larry Ferno. Peter estimates that the 550 with a new motor would bring about 35 K to
40k. Larry suggested that the town should consider bypassing the local dealers and instead, contacting Ford Motor
Company directly. Meanwhile, concern is expressed on the need for a working vehicle for winter. The process with

Ford could take some time. The WSB will contact Ford to start a conversation with them. It may be wise to ask for
legal advice on how to approach Ford.
Peter has met with a potential candidate for the third full- time road crew position. The WSB will schedule an
interview with the interested person. A tentative date of Monday or Wednesday of next week – August 17 or 19.
Grant Updates: with Michael Gray
Michael has received the FY 27 GIA grant agreement. The WSB authorized Michael to sign the agreement on behalf
of the town. The grant is for 17k with $4,250 as the town match. Peter is planning on using the funding for work on
Foster Hill Road this summer, if time allows or if not, next summer. Michael thinks it would be best to plan on using
the pavement grant funds for Foster Hill Road repaving next summer. He has not been able to put together the RFP
for this project and feels it is too late to try to have the work done this year.
Town Treasurer’s Report with Lilly Baron
Fund Balance Report The Town's total cash on hand is $284,084, which remains above the threshold that would
require the use of the Tax Anticipation Note (TAN).
As expected, the General Fund has moved into a deficit position. The FEMA-related deficit also remains
in this month’s report , causing the Highway Fund and Town Maintenance Fund balances to appear higher
than they otherwise would. This will be corrected next month when the appropriate fund transfers are
completed to offset the FEMA deficit.
The Reappraisal Fund reflects a slight decrease this month as the town has begun making payments to
NEMRC for the Town's reappraisal project. The work has begun but will not be completed until 2028. Under the
terms of the contract, the Town will make monthly payments of $4,120 over the next 24 months.
The General Fund ended July with a $52,221 deficit, reflecting the seasonal pattern of slower revenue
collections combined with higher expenditures during the month. Significant expenditures included the
first annual payment to the Fire Department for annual membership and service fees and the payment of
one-half of the County taxes. During July, the Town collected $10,559 in delinquent property taxes and $24,667 in
current-year state tax credit payments.
The Highway Fund is currently operating with a $3,576 budget surplus, contributing positively to the
Highway Fund Balance. During the month, the Town received its annual State Highway Aid allocation,
which included a modest increase over last year. In addition, the Town received a $10,198 Swenson
reimbursement. Overall, the Town's net budget position is - $48,645. This position is expected to improve by the
end of this month as the town begins to receive FY27 tax payments.
Updates on Buyouts with John Gordon
Five asbestos abatement contractors met with him today for a site visit of the 2 FEMA buyouts in the village.
Discussion then turn ed to the contract award for the demolition of the 2 FEMA buyout sites. John contacted
references provided by the potential contractor and that the references were outstanding. John recommend ed
that the demo contract be awarded to LG Ferno Forest Products LLC, as they were the lowest bidder, had attended
the site visit and the afore mentioned references were positive. The WSB again approved awarding the contract to
LG Ferno Forest Products. Larry states that he cannot do any work on the demolition of the buildings until the
asbestos abatement work is done but may be able to start other work for the project sites. He anticipates starting
work soon at the “yellow house”, addressing the well and cleaning up the driveway area to prepare for the
demolition. John prepared a draft co ntract for the demolition work and asked the WSB to review it, so that it can be
signed at the special meeting next week.

Updates and Other Business

East Long Pond Dam Repair: A MOU draft from the East Long Dam Repair committee has been sent to the WSB for
their review. Chris will send the MOU to the town’s lawyer, David Mears, for his review.
WSB Special Meeting: The WSB set a tentative date for a special meeting - Monday, August 17
th
- to finalize the tax rate; to interview the potential Road Crew member f or hire and to finalize the demolition contract.

Bills and Payroll: Bills and payroll orders were signed at the end of the meeting.

Public Comment None
Road Report with Peter Dailey
Peter has contacted a mechanic who could do the "forensics" on the 550 to determine if McGee Ford might be
liable for the motor's sudden breakdown shortly after McGee returned the 550 to the road crew after repairing the
exhaust system. Suspicions were raised when the motor blew and McGee denied any responsibility. Peter wants
to know if the WSB would like to pursue this; discussion follows. John asks what the trade-in value would be for the
550 with a blown motor; Peter responds about $7,000. With a new motor, the trade-in is estimated to be $35,000
to $40,000 (Lilly's research on line.) Larry Ferno suggested a way to proceed to weigh the costs and trade-in values
of the 550 to help with the decision to research the cause of the blown engine and then approach Ford Motor
Company, not a local dealer. Peter asks if he should hold off on this and John requests that he find out what the
trade-in value of the 550 would be if it had a new engine in it.
The road crew has been upgrading culverts on Log Town Road. Peter reported that the cement floor of the salt
shed is deteriorated and needs to be replaced. Pieces of cement can show up in the salt spreader, compromising
its function. They will have to move the existing salt into a truck body temporarily. He may take up this project
while waiting for the Valley Lake Road culvert project, at which time the road crew anticipates working on the
section of Valley Lake Road that leads into the village.
Grant Updates: with Michael Gray
The Valley Lake Road culvert replacement project in the village will begin on August 10
th
. The contractor
anticipates it will take 21 /2 to 3 weeks to complete. Its possible that the work will not be done before school
starts. Logistics are discussed around this work, the closing of the road, detours etc. Michael will oversee the road
closure and getting the word out to town residents and the school. A detour route will also be established.
The BRIC Buck Lake Brook Watershed study, with the usual last minute FEMA twists, has made it to the
"submitted" phase. There is no anticipated time frame for when an award will be decided.
Michael presents the 2026 Town Road and Bridge Standards letter of compliance, which the WSB signs.
Town Clerk and Zoning Administrator's Report with Graham Christie
Town Clerk Report-There has been a complaint of a dog wandering onto a neighbor's property. Graham is
informed that the ACO reports to the TC. Graham will contact the ACO and the ACO will then call the neighbor.

ZA Report -Graham would like to update the zoning ordinance (ZO) which is outdated. Graham would like to be
working with a ZO that is current with statutes to establish an even playing field for the ZA and town residents.
There is a grant, the Bylaw Modernization Grant -from the Department of Housing and Community Development
that could help fund the hiring of a consultant to assist the town with the update of its ZO. Diana feels that the
town would need to reestablish its Planning Commission, in order to apply for the grant. John is supportive of
updating the ZO. The WSB will put out a notice to seek new WPC members.
Town Treasurer's Report with Lilly Baron
Lilly presented a FY 26 year end report to the WSB. The Town completed FY26 with
the combined General Fund and Highway Fund on budget. The Town kept expenditures $36,037 below the
budget approved by voters at Town Meeting, which more than offset revenues being $35,384 less than
anticipated. Available funds dropped sharply-by $1,085,201 -in FY26, from $1,431,004 to $345,803. The
causes were FEMA repayment, higher-than-anticipated equipment costs, and the lingering effect of the FY25
tax rate being set too low. The major change from the budget was that the Town collected less revenue than
budgeted, by a negative $54,219. Most of this was budgeted delinquent property taxes that did not materialize.
This was the primary reason revenues for the General Fund were less than budgeted by $51,893. At year-end,
outstanding delinquent taxes totaled $83,507.
The Highway Fund took in slightly more revenue than budgeted, mainly because of residual funding from
FEMA 2024, an increase in state highway aid, and a higher than anticipated Swenson reimbursement.
Expenditures were slightly under budget though a few budgeted amounts -insurance costs and several
unexpected equipment repairs -did exceed what was budgeted. Even with these unanticipated expenses,
total expenditures for the Highway Fund remained well below budget.
At the close of FY26, the Town had total cash on hand of $345,803. The General Fund ended the fiscal year
with a fund balance of $51,542, while the Highway Fund ended the year with a fund balance of $140,101. Fund
balances were impacted by three significant financial events during the year:
• A truck forecast to cost about $200,000 that actually cost about $300,000, resulting in a deficit in the
Highway Equipment Reserve Fund. After scheduled transfers, reimbursements, and equipment sale proceeds,
the remaining HERF deficit at year-end was a negative $36,874.
• The Town incurred a $104,216 FEMANEM repayment after previously receiving authorization to use excess
flood recovery funds for additional mitigation projects. After those projects were completed, FEMA and VEM
reversed their previous position and required that the funds be returned. (These funds paid for new roofs on the
Town Hall and Town Office, and several culvert replacements.)
• The FY25 tax rate error, although resolved during FY26, had already reduced available fund balances and
continues to affect the Town's financial position.
Fund Deficit Resolution Lilly then addressed the two outstanding deficits, one with the HERF and the other
with the FEMA repayment obligation. Lilly recommended leaving the HERF as is and allowing the deficit to be
replaced over time. Regarding the FEMA repayment, Lilly presented two options. Option 1 is to
use existing available funds and Option 2 is to file a formal FEMA deficit claim. For the FEMA repayment
obligation, Lilly recommends Option 1 -to resolve the deficit using available existing funds, leaving the town with
very little cash balance going into tax collection time. She pointed out that the resulting impact would need to be
addressed through future tax revenue over multiple budget cycles. However utilizing available funds would
eliminate the outstanding deficit immediately. Option 2 would be to formally "claim"; the deficit. This one-time
option would allow the Town to increase the tax rate in increments of 5% until the full deficit has been recovered.
This approach would restore the Town's unassigned fund balance and FEMA deficit in a single year. This would
require raising approximately $105,000 more through taxes and would result in an estimated 30% increase in the
municipal tax rate. Although this is the quickest way to resolve the deficit, it would also create a significant impact
on taxpayers. Again, Lilly recommended the first option. John also favors the first option. John also recommends

not budgeting for the delinquent tax revenue as this amount is unpredictable and varies from year to year. No
decision is made on the FEMA repayment at this meeting.
Updates on Buyouts with John Gordon
John asked VEM if management of the asbestos abatement would be payable under the grant and was told yes,
the grant could cover that. Clay Point Associates, Inc. has offered to manage the asbestos abatement and will
prepare the RFP for bidding on the abatement, for a price of $1,===. Once a bid is chosen the town will need to
check in with VEM for any needed changes in the budget. Clay Point found asbestos in both of the buyout
buildings. Diana made the motion to hire Clay Point to manage the bidding process for asbestos remediation; WSB
approved the motion. John asks Lilly if Clay Point has submitted Certificate of Insurance (COi); Lilly answered that
they have not and it would be best practice for the COi to be in place before they are officially hired.
The WSB then opened the two sealed bids received for the demolition work on the FEMA buyouts. Bids are
reviewed. John points out that only one bidder came for the site visit and that bid is the lowest. The other bid is
higher and the contractor did not come for a site visit .. In any case, the low bidder did attend the site visit and the
contractor, Larry Ferno, was chosen. Larry suggested that the WSB check the references he supplied with the
lower bid and make their final decision at the August 10
th
WSB meeting.
Personnel Policy with Lilly Baron
Lilly made the corrections that were suggested at the July 13
th
meeting. The WSB adopted the policy.

Woodbury Select Board
Minutes of the Special Meeting
Tuesday, July 21, 2026, 5:30 P.M.
at the Woodbury Town Office
The meeting was called to order by the Chairman at 5: 3 0. Present were the
Select Board Members and Treasurer Lilly Baron. John Holahan, local camp
owner, also attended.
Adjustments to the agenda: the first Executive Session was moved up. Update on
buyouts was added
Executive Session: At 5 :35 The Board voted to enter executive session pursuant
to 1 V.S.A. §313(a)(l)(E) and (F)-negotiations possibly resulting in legal action.
The Session was closed at 5:40. The Board voted to approve the proposed
response to Swenson Granite/Polycor based on suggestions by Attorney Mears.
Budget analysis: Lilly presented an end-of-fiscal-year summary including
suggested adjustments for the tax rate discussion. After an initial review, the
Board decided to go into Executive Session to discuss personnel wage issues prior
to addressing the budget/tax rate.
Executive Session: at 6:00 the Board convened an Executive Session pursuant to 1
V.S.A. §313(a)(l)(B). The session closed at 6:30. The following changes were
discussed and approved:
Based on recommendations from Town Audit Chair John Reid, (and based on an
annual wage survey by the Vermont League of Cities and Towns) and the Board's
concern for retaining qualified staff, it was decided to increase the wages of paid
staff and elected officials, in an attempt to bring these wages closer to an average
wage for similar positions in Vermont towns. These four paid employees have
proven their dedication to their positions and professional performance.
Graham Christie -Town Clerk -upon completion of four months, $30.00. At 24
hours a week this item will total less than was budgeted for FY27.
Lillian Baron, Treasurer -Lilly has shown exemplary skill in her position. She has
taken on additional duties on behalf of the Select Board. She is now approved to
work 30 hours a week which qualifies as a Full-Time employee under state law.

She will now qualify for Health Insurance and other benefits. Her hourly wage is
increased from $32.45 to $35.50.
Graham and Lilly have worked together for several months and now plan to cover
the duties of Assistant Town Clerk, thus saving most of the~ budgeted for

Road Commissioner Peter Dailey and Road Crew member Tim Neill will each
receive an hourly wage increase of $3.00.
Review end-of-year finances in detail, compare to FY2027 approved budget.
The board studied the budget and actual, and discussed ways to reduce the
tax rate from what was originally approved in the Town Report Budget.
-$20,000 must be added to the Road budget to account for the bid on the
Valley Lake Road culvert project.
-$15,000 can be deducted from the culvert budget
-The estimate for the Swenson reimbursement can be increased from $25,000
to $30,000, following what has been received in recent years
-Decrease the allocation into the HERF from $125,000 to $115,000
-Road crew budget -likely savings on health insurance and other full time
benefits during staff shortages.
Further adjustments may be necessary to address the deficit created when FEMA
refused to allow use of un-deobligated funds which financed new roofs on two
town buildings.
These adjustments have so far reduced the pending tax rate from $0.974 per $100
of property value (as based on the voted budget) to .943

Valley Lake Road Closure

Construction for the replacement of the Kingsbury Brook culvert in Woodbury Village, as you first enter Valley Lake Road from Rte. 14, is scheduled to begin on August 10th. Work on the replacement is expected to last for 2 1/2 to 3 weeks. This section of road will be closed off to traffic during this period of work. It will be closed off from Rte. 14 on the east side of Kingsbury Brook and closed off at the food shelf on the west side. A detour will be set up to provide access to the school, library and homes on Valley Lake Road. The suggested detour route will be clearly marked at every turn and twist of the roads leading to the village buildings on the other side of the culvert. The suggested detour route is to turn onto Foster Hill Road, off Rte. 14 in South Woodbury (right across from the town office and church), continue on the paved section of Foster Hill Road, turn right onto Dog Pond Road and continue on Dog Pond Road to Wheeler Hill Road. Continue on Wheeler Hill Road until it meets Valley Lake Road and then turn right. You'll soon see the school and library. Town of Woodbury Select Board Meeting Minutes July 27, 2026 Attendees Select Board Members: Diana Peduzzi, John Gordon Town Officials: Lilly Baron (Town Treasurer); Graham Christie (Town Clerk); Town Employees: Peter Dailey (Road Commissioner); Michael Gray (WSB assistant) Members of the Public: Larry Ferno Media: Jerome Lipani – HCTV Call to Order John called the meeting to order at 6:02 P.M. Adjustments to Agenda Town Roads and B ridges Standards confirmation statement Approval of Previous Meeting Minutes The minutes from July 13, 2026 Select Board meetings were approved. Public Comment None Road Report with Peter Dailey Peter has contacted a mechanic who could do the “forensics” on the 550 to determine if McGee Ford might be liable for the motor’s sudden breakdown shortly after McGee returned the 550 to the road crew after repairing the exhaust system. Suspicions were raised when the motor blew and McGee denied any responsibility. Peter wants to know if the WSB would like to pursue this; discussion follows. John asks what the trade-in value would be for the 550 with a blown motor; Peter responds about $7,000. With a new motor, the trade-in is estimated to be $35,000 to $40,000 (Lilly’s research on line.) Larry Ferno suggested a way to proceed to weigh the costs and trade -in values of the 550 to help with the decision to research the cause of the blown engine and then approach Ford. Peter asks if he should hold off on this and John requests that he find out what the trade-in value of the 550 would be if it had a new engine in it. The road crew has been upgrading culverts on Log Town Road. Peter reported that the cement floor of the salt shed is deteriorated and needs to be replaced. Pieces of cement can show up in the salt spreader, compromising its function. They will have to move the existing salt into a truck body temporarily. He may take up this project while waiting for the Valley Lake Ro ad culvert project, at which time the road crew anticipates working on the section of Valley L ake Road that leads into the village. Grant Updates: with Michael Gray The Valley Lake Road culvert replacement project in the village will begin on August 10 th . The contractor anticipates it will take 21/2 to 3 weeks to complete. Its possible that the work will not be done before school starts. Logistics are discussed around this work, the closing of the road, detours etc. Michael will oversee the road closure and getting the word out to town residents and the school. A detour route will also be established. The BRIC Buck Lake Brook Watershed study , with the usual last minute FEMA twists, has made it to the “submitted” phase. There is no anticipated time frame for when an award will be decided. Michael presents the 2026 Town Road and Bridge Standards letter of compliance, which the WSB signs. Town Clerk and Z oning Administrator’s Report with Graham Christie Town Clerk Report – There has been a complaint of a dog wandering onto a neighbor’s property. Graham is informed that the ACO reports to the TC. Graham will contact the ACO and the ACO will then call the neighbor. ZA Report – Graham would like to update the zoning ordinance (ZO) which is outdated. Graham would like to be working with a ZO that is current with statutes to establish an even playing field for the ZA and town residents. There is a grant, the Bylaw Modernization Grant – from the Department of Housing and Community Development that could help fund the hiring of a consultant to assist the town with the update of its ZO. Diana feels that the town would need to reestablish its Planning Commission, in order to apply for the grant. John is supportive of updating the ZO. The WSB will put out a notice to seek new W PC members. Town Treasurer’s Report with Lilly Baron Lilly presented a FY 26 year end report to the WSB. The Town completed FY26 with the combined General Fund and Highway Fund on budget. The Town kept expenditures $36,037 below the budget approved by voters at Town Meeting, which more than offset revenues being $35,384 less than anticipated. Available funds dropped sharply – by $1,085,201 – in FY26, from $1,431,004 to $345,803. The causes were FEMA repayment, higher-than-anticipated equipment costs, and the lingering effect of the FY25 tax rate being set too low. The major change from the budget was that the Town collected less revenue than budgeted, by a negative $54,219. Most of this was budgeted delinquent property taxes that did not materialize. This was the primary reason revenues for the General Fund were less than budgeted by $51,893. At year- end, outstanding delinquent taxes totaled $83,507. The Highway Fund took in slightly more revenue than budgeted, mainly because of residual funding from FEMA 2024, an increase in state highway aid, and a higher than anticipated Swenson reimbursement. Expenditures were slightly under budget though a few budgeted amounts - insurance costs and several unexpected equipment repairs – did exceed what was budgeted. Even with these unanticipated expenses, total expenditures for the Highway Fund remained well below budget. At the close of FY26, the Town had total cash on hand of $345,803. The General Fund ended the fiscal year with a fund balance of $51,542, while the Highway Fund ended the year with a fund balance of $140,101. Fund balances were impacted by three significant financial events during the year: ● A truck forecast to cost about $200,000 that actually cost about $300,000, resulting in a deficit in the Highway Equipment Reserve Fund. After scheduled transfers, reimbursements, and equipment sale proceeds, the remaining HERF deficit at year-end was a negative $36,874. ● The Town incurred a $104,216 FEMA/VEM repayment after previously receiving authorization to use excess flood recovery funds for additional mitigation projects. After those projects were completed, FEMA and VEM reversed their previous position and required that the funds be returned. (These funds paid for new roofs on the Town Hall and Town Office, and several culvert replacements.) ● The FY25 tax rate error, although resolved during FY26, had already reduced available fund balances and continues to affect the Town’s financial position. Fund Deficit Resolution Lilly then addressed the two outstanding deficits, one with the HERF and the other with the FEMA repayment obligation. Lilly recommended leaving the HERF as is and allowing the deficit to be replaced over time. Regarding the FEMA repayment, Lilly presented two options. Option 1 is to use existing available funds and Option 2 is to file a formal FEMA deficit claim. For the FEMA repayment obligation, Lilly recommends Option 1 – to resolve the deficit using available existing funds, leaving the town with very little cash balance going into tax collection time. She pointed out that the resulting impact would need to be addressed through future tax revenue over multiple budget cycles. however utilizing available funds would eliminate the outstanding deficit immediately. Option 2 would be to formally “claim” ; the deficit. This one-time option would allow the Town to increase the tax rate in increments of 5% until the full deficit has been recovered. This approach would restore the Town’s unassigned fund balance and FEMA deficit in a single year. This would require raising approximately $105,000 more through taxes and would result in an estimated 30% increase in the municipal tax rate. Updates on Buyouts with John Gordon John asked VEM if management of the asbestos abatement would be payable under the grant and was told yes , the grant could cover that. Clay Point Associates, Inc. has offered to manage the asbestos abatement and will prepare the RFP for bidding on the abatement, for a price of $1,=== . Once a bid i s chosen the town will need to check in with VEM for any needed changes in the budget. Clay Point found asbestos in both of the buyout buildings. Diana made the motion to hire Clay Point to manage the bidding process for asbestos remediation; WSB approved the motion. John asks Lilly if Clay Point has submitted Certificate of Insurance (COI); Lilly answered that they have not and it would be best practice for the COI to be in place before they are officially hired. The WSB then opened the two sealed bids received for the demolition work on the FEMA buyouts . Bids are reviewed. John points out that only one bidder came for the site visit and that bid is the lowest. The other bid is higher and the contractor did not come for a site visit.. In any case, the low bidder did attend the site visit and the contractor, Larry Ferno, was chosen. Larry suggested that the WSB check the references he supplied with the lower bid and make their final decision at the August 10 th WSB meeting. Personnel Policy with Lilly Baron Lilly made the corrections that were suggested at the July 13 th meeting. The WSB adopted the policy. Updates and Other Business Bills and Payroll: Bills and payroll orders were signed at the end of the meeting.
